Colonel Ralitera in arbitrary detention

"I just inform you that as we have feared, Ralitera and others were not released today (November 7) whereas their committal order expired at midnight on November 6."

The reason according to the clerk of the Central Antanimora house is that the documents order transmission to the court of criminal appeal is worth a detention and its validity is 1 year. This explanation comes from the clerk of the Dean of Judges. However, the minutes of notification does not mention this detention extension in any way. We therefore do not know how long we will remain in prison or when the trial will take place and more importantly why we are still in prison. Currently, there is no more a lawful detention. Statutory periods of preventive detention have expired. 18 months! They are currently in arbitrary detention.

 The presumption of innocence exists, and arbitrary detention is unlawful. "This information comes from Ihanta Randriamandranto, wife of Colonel Ralitera detained since May 6, 2009.

Deans of political prisoners

The colonel as well as his cellmates have been jailed for 18 months. Indeed, Colonel Ralitera Andriamalala Andrianandraina "HCC Security Director," Captain Razafindrakoto Jean de Dieu "HCC security officer," Chief Warrant Officer Rakotomanga Andrianarimanana "Shooting, Arms and Ammunition (TAM) NCO to HCC," Inspector Fanomeza Razanadimby" Chief of HCC Operating provision "and Sergeant Chief Raharinjatovo George Martin, Colonel Ralitera’s " bodyguard " have been retained at Antanimora  for five criminal charges including "the destruction of public property and buildings, assassination of an Ambohijatovo bookseller, murder of police officer Christian Sambe in Anosy, possession and supplies of illegal weapons and vehicle supplies to bandits associations in order to create public disorder. "

Illegal and arbitrary

For the defense consisting of Yves Ratrimoarivony, and Mr. Solo Ratrimoarivony, the imprisonment of these HCC five employees is purely political. "It is an illegal and illegitimate decision" denounces the former barrister. For him, "the detention order comes from the current political leaders." He thus seeks enforcement "if it really exists in Madagascar," he lets know. "Malagasy Justice is neither independent nor fair," reveals Yves Ratrimoarivony, too, "I appeal to the judges’ conscience in this case." In his explanation, Barrister Yves Ratrimoarivony denounces the procedural defect. Indeed, the defense lawyers were not notified about the "order of documents transmission to the court of criminal appeal, dated November 4, 2010.” This order was directed to the defendants for signing.  And to cap it all, the transmission order to the court of criminal appeal mentions that Ihanta Randriamandranto Colonel Ralitera's wife is "the leader of legalist women," a remark that has nothing to do in the case.

Inert HCC

Faced with "this injustice", "these deans of political detainees" families have decided to move heaven and earth to secure the release of their relatives. "We will use international bodies like Amnesty International, or organizations dealing with human rights," indicates Ihanta Randriamandranto. The French Embassy and Consulate are closely following the case progress, especially in regard of Colonel Ralitera because of his French citizenship. Nevertheless, these families regret the HCC leaders’ callousness on the matter.
